The Biden administration has asked a Utah federal judge to dismiss a lawsuit that aims to invalidate Bears Ears and Grand Staircase-Escalante national monuments and bar the president from declaring new ones that protect entire landscapes.
The case should be tossed out because Congress hasn’t provided for judicial review of presidential actions under the Antiquities Act, Assistant Attorney General Todd Kim wrote in the Jan. 5 motion. Utah and other plaintiffs also lack standing because none has been injured by the monuments, and the plaintiffs have misinterpreted the law, Kim wrote.
