BGOV Bill Analysis: S. J. Res. 12, Repeal Methane Fee Rule

A Biden administration rule imposing fees on companies that emit excess methane would be blocked through the Congressional Review Act under S. J. Res. 12.

The rule, finalized by the Environmental Protection Agency on Nov. 18, implements a provision from Democrats’ 2022 climate-tax-health law (Public Law 117-169).

In accordance with the law, the rule levies penalties for methane emissions above a certain threshold, totaling $900 per metric ton for excess emissions reported in 2024 and increasing to $1,500 by 2026.
