Berkey Filters Must Face Pesticide Registration, Judge Says

A company that manufactures Berkey water filters lost its attempt to reverse an EPA rule that required the filters to be registered as a pesticide after a federal judge held that the manufacturer didn’t have standing to bring its claims.

“Royalties from sales from a third party are not enough to support standing,” Mark T. Pittman of the US District Court for the Northern District of Texas said. Berkey itself is not a party to the lawsuit, which Pittman said he was “flummoxed” by.
