A federal court in California sent back to state court a breach of contract case over a study for a battery energy storage project carried out by a not-for-profit utility.
CMD Carson LLC and Carson Hybrid Energy Storage LLC alleged that non-public electric utility Turlock Irrigation District breached a contract to study the feasibility of the company’s project, which could potentially interconnect with the utility’s transmission system and deliver electricity.
The accusations include, among others, removing agreed-upon study parameters and adding new ones, as well as refusing to allow the company to arrange compensation to relevant third parties.
