The US Army Corps of Engineers unlawfully approved the construction of a confined aquatic disposal—or CAD—facility in Newport Harbor, an environmental group alleged in a federal complaint.
Friends of Newport Harbor said that the agency didn’t conduct an environmental review on the potential impacts of the facility, which would hold sediment that has been dredged by the agency but deemed unsuitable for open ocean disposal.
The sediment includes mercury levels exceeding Environmental Protection Agency thresholds and other toxic waste, the group said.
