The US Army Corps of Engineers asked an appeals court to uphold its decision to issue a Clean Water Act permit for the expansion of an oil terminal in Texas, following a challenge from multiple indigenous groups.
The decision was reasonable and complies with the National Environmental Policy Act and CWA, the agency told the US Court of Appeals for the Fifth Circuit on March 8.
