3M Win Gives It Shot at Keeping State PFAS Case in Federal Court

A federal appeals court ruled Tuesday that the 3M Co. has the right to seek to defend itself against Vermont’s PFAS damage claims in federal court.

The US Court of Appeals for the Second Circuit vacated last year’s ruling by the US District Court for the District of Vermont, which said Vermont’s natural resource damage case would remain under the state court’s jurisdiction.

The lower court was wrong to determine 3M took too long to try and transfer the case from Vermont’s Superior Court to the federal district court, the Second Circuit said.
