3M, Atotech Must Face Missouri Drinking Water Contamination Suit

3M Co. and Atotech can’t shake a class action suit over forever chemicals that leaked into the drinking water of a Missouri town.

3M and Atotech could have reasonably foreseen the damages from the hazardous chemicals they sold to the SRG Global Coatings electroplating facility in Portageville, Mo., the US District Court for the Eastern District of Missouri ruled Wednesday, denying their motion to dismiss.

“Although thin, plaintiffs have pleaded what defendants 3M and Atotech deny—that those defendants manufactured and sold the chemicals SRG used that ultimately leeched into the plaintiffs’ water source,” Judge Stephen N. Limbaugh Jr. wrote.
