NRC Seeks High Court Review of Texas Nuclear Waste License Fight

Nuclear regulators want the US Supreme Court to review a decision that struck down a nuclear waste storage license for a privately owned, temporary site in West Texas in a case involving the major questions doctrine.

The US Court of Appeals for the Fifth Circuit ruled in August 2023 that the Nuclear Regulatory Commission exceeded its authority when it issued a license in September 2022 to Interim Storage Partners, a joint venture planning to develop a nuclear waste site in Andrews County, Texas.
