UPS Beats Former Driver’s Discrimination, Retaliation Claims

United Parcel Service Inc. didn’t discriminate against a former delivery driver when it reassigned him to part-time work following an on-the-job injury that forced him to take narcotics for pain.

Although UPS had a legal obligation to accommodate plaintiff Worthy McGuire under the Americans with Disabilities Act, the company didn’t have to offer him a job that violated the seniority system it negotiated with his union, the Teamsters, a federal appeals court ruled March 28.
