Lowe’s Wage, Background Check Lawsuit Sent to Arbitration

Lowe’s Home Centers LLC won its bid to arbitrate claims alleging improper background checks and wage violations, according to a Dec. 20 ruling of the U.S. District Court for the Northern District of California.

Jazmin Alvarado accuses Lowe’s of conducting background checks during its hiring process without making proper disclosures, as well as wage violations. She sought to have her case proceed in court and be certified as a class action.

Alvarado’s employment contract, however, mandates that disputes be settled in arbitration. It also bars class actions.

The court rejected Alvarado’s claim that the arbitration agreement was invalid.
