Judge Upholds Safety Penalty for Death of Worker Under Excavator

An OSHA citation against a MasTec Inc. subsidiary, stemming from the death of a construction worker crushed underneath a 2,500-plus pound excavator bucket, has been upheld by a federal administrative law judge.

The final order, released Monday, confirmed a general duty clause citation and $11,747 fine against American Civil Constructors LLC of Littleton, Colo.

An attorney for American Civil, Travis Vance of Fisher Phillips LLP in Charlotte, N.C., said the company would appeal the final order to a US appeals court.
