Firm’s Facebook Snooping Won’t Stop Injunction on Ex-Employees

Engineering firm Scherer Design Group LLC is entitled to a preliminary injunction that bars four former employees from contacting its clients.

A divided U.S. Court of Appeals for the Third Circuit upheld the injunction, saying SDG’s act of snooping on one of the ex-employees’ Facebook account didn’t rise to the level of “unclean hands” that would make the company ineligible for the injunction.

SDG provides services to wireless carriers and other telecommunications vendors. One of its employees, Chad Schwartz, resigned and started two competing engineering firms. Schwartz also successfully recruited three other Scherer employees.
