A CVS store manager will get a second chance to show that she doesn’t have to arbitrate claims that her male boss subjected her to pervasive sex-based harassment.

A lower court considered materials outside the allegations in the store manager’s lawsuit when it found the pact was enforceable, the US Court of Appeals for the Third Circuit said Wednesday.

Her suit didn’t fall under the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, which would have allowed her to opt-out of arbitration even if her agreement with CVS Pharmacy Inc. and New Jersey CVS Pharmacy LLC is valid, ...
