The US Labor Department’s attempt to withdraw support from Yale University employees in a retirement plan class action has no “logical basis” and should be rejected, the workers told the Second Circuit.
The employees Thursday objected to the department’s request to withdraw its 2023 amicus brief supporting them and urging a plaintiff-friendly standard for holding retirement plan fiduciaries liable for breaches of duty under the Employee Retirement Income Security Act.
