Wisconsin Judge Weighs SCOTUS Ruling on 401(k) Plan Fee Lawsuits

Another federal judge weighed in on the U.S. Supreme Court’s Jan. 24 decision on 401(k) plan fees, declining to dismiss two Wisconsin lawsuits and asking the defendant employers how they want to proceed with the litigation.

Chief Judge Pamela Pepper of the U.S. District Court for the Eastern District of Wisconsin on Wednesday denied motions to dismiss filed by Froedtert Health Inc. and Quad/Graphics Inc. in pending lawsuits challenging their retirement plan fees under the Employee Retirement Income Security Act.
