Whataburger Restaurants LLC is facing a federal lawsuit challenging its practice of charging employees who smoke an extra $900 per year for healthcare coverage.
The fast food chain charges these penalties without providing workers with a legally-compliant method for having them removed, a former Whataburger employee said in a proposed class complaint filed Tuesday in the US District Court for the Western District of Texas. Whataburger waives penalties for workers who complete a quit-smoking program by Sept. 30 of a given year, but this “arbitrary deadline” flouts relevant legal guidelines, according to the lawsuit.
