Virtua Health Retirement Plan Lawsuit Moves Forward After Trim

Virtua Health Inc. must face a pared-back lawsuit by workers saying their retirement plans are plagued by pricey mutual funds and a stable value fund that allowed a plan service provider to reap outsized profits.

Judge Christine P. O’Hearn on Sunday ordered Virtua to defend claims that it breached its fiduciary duties under the Employee Retirement Income Security Act by failing to appropriately monitor the plans’ investment options, including a stable value fund from plan recordkeeper Lincoln Financial Group.

But she dismissed a challenge to the plans’ administrative fee levels, along with certain claims raised against Lincoln.
