UPS Retirees Continue Fight Over Government-Backed Pension Cuts

UPS Inc. retirees challenging government decisions that allowed their Teamsters pensions to be cut by more than $1,000 per month asked the Federal Circuit to rule that the moves were an unconstitutional taking of private property.

The 2014 pension law that authorized the benefit cuts resulted in a government taking of valuable property in which the retirees had an enforceable, vested interest, they said in a brief filed Monday in the US Court of Appeals for the Federal Circuit. According to the retirees, the law qualifies as a “per se” unconstitutional taking of property.
