UPS Retirees Appeal Loss in Takings Suit Over Teamsters Pension

UPS Inc. retirees challenging government decisions that allowed their Teamsters pensions to be cut by up to 29% asked the Federal Circuit to revive their lawsuit claiming an unconstitutional taking of property.

The retirees’ appeal, docketed Tuesday in the US Court of Appeals for the Federal Circuit, challenges a decision holding that the government-approved reduction in their benefits didn’t have a significant enough economic impact to be an unconstitutional regulatory taking of property.
