United of Omaha Loses Appeal to Accountant in Disability Battle

United of Omaha Life Insurance Co. must reconsider a disability benefit claim by an accounting firm manager who says her chronic conditions and related medications render her unable to work.

United mishandled Shirley Lacko’s claim by cherry-picking medical evidence and failing to address whether her combination of ailments, and the impact of her medication, prevented her from performing the skilled work needed to manage an accounting firm, the U.S. Court of Appeals for the Seventh Circuit said June 12. The court sent Lacko’s claim back to United for reconsideration of the claim.
