U.S. Bank Blasts Government Brief in Pension Standing Dispute

A lawsuit accusing U.S. Bank NA of mismanaging its pension plan isn’t a good candidate for U.S. Supreme Court review, despite what the federal government said in a recent brief, the bank told the justices.

The solicitor general’s brief “reads like a recommendation” against taking the case, despite its ultimate conclusion that the court should grant review, the bank said June 3. The case doesn’t involve a disagreement among the federal appeals courts, and the solicitor never explained why this particular case was a good vehicle for addressing unresolved questions of pension plan standing, the bank said.
