California’s retirement program for employees who don’t have access to employer-sponsored benefits faces a renewed legal challenge after a federal judge upheld the program last month.
Howard Jarvis Taxpayers Association, a California policy group that advocates for lower taxes, filed an amended complaint April 11, renewing its argument that the program is preempted by the federal Employee Retirement Income Security Act.
The new complaint emphasized the administrative burdens placed on employers by the CalSavers program, which the group says interferes with “employer autonomy” to postpone or select other options valid under ERISA.
