An immunocompromised oral surgeon revived part of his lawsuit saying Paul Revere Life Insurance Co. wrongly denied him disability benefits when he stopped working after failing to secure personal protective equipment during the Covid-19 pandemic.
The surgeon should have been allowed to argue at trial that he couldn’t safely perform his job during the height of the pandemic and thus was disabled under the terms of his insurance policy, the US Court of Appeals for the Ninth Circuit said Monday in an unpublished opinion.
