SuperValu Can’t Lower Pension Exit Bill on Appeal, 7th Cir. Says

Supermarket chain SuperValu Inc. failed to convince the Seventh Circuit to reduce the $22.6 million bill it incurred when it withdrew from a pension fund covering unionized workers.

The dispute centered on how to interpret the complex statutory rules governing how pension funds calculate the amounts owed by withdrawing employers. The United Food & Commercial Workers Unions & Employers Midwest Pension Fund made certain reductions to SuperValu’s bill to account for a 2018 transaction in which it sold multiple stores to Schnuck Markets Inc., but SuperValu said these reductions should have been even greater.
