Sun Life Disability Claim Revived by Fractured Second Circuit

A former dental supply sales representative can seek disability benefits from Sun Life Assurance Co. of Canada after the Second Circuit said she didn’t release those claims in her separation agreement with her employer.

The sales rep didn’t knowingly and voluntarily release her Employee Retirement Income Security Act claims against the insurer when she signed a contract in connection with leaving her job at Benco Dental Supply Co., the US Court of Appeals for the Second Circuit said Thursday in a 2-1 split opinion reviving her claims against the insurer.
