Sun Life Defeats Veterans’ Disability Benefits Lawsuit

Sun Life Assurance Co. of Canada defeated a proposed class action by a veteran who says it wrongly shorts disability payments to “thousands” of veterans and service members.

The insurer is within its legal rights to offset the benefits it pays to veterans and service members who also get disability payments from the federal government because of their military service, a federal judge ruled Oct. 16.

In particular, the judge said Sun Life wasn’t in violation of the Veterans’ Benefits Act, the Employee Retirement Income Security Act, or the Uniformed Services Employment and Reemployment Rights Act, the federal law protecting ...
