Sun Life Beats Appeal Over Disability Benefit Miscalculation

Sun Life Assurance Co. of Canada beat an appeal by a former Capital One Financial Corp. employee who said his long-term disability benefits were miscalculated.

Michael Faciane’s suit, nearly 10 years after he saw the alleged miscalculation, was untimely, the U.S. Court of Appeals for the Fifth Circuit said July 25.

Faciane’s long-term disability plan provided a three-year limitations period.

Faciane was injured in 2006. In March 2008, Sun Life sent him a letter with his salary and disability benefit information.
