Southeastern Freight 401(k) Suit Gets Class Nod, Not Expansion

A lawsuit challenging Southeastern Freight Lines Inc.'s retirement plan fees is now a certified class action covering about 10,000 people.

Judge Sherri A. Lydon on Monday certified a class covering all the California-based trucking company’s retirement plan participants and beneficiaries since January 2018, which is the date identified in the complaint as the starting period for the company’s alleged mismanagement of the plan.

Plaintiff Curtis Whipple, a former Southeastern employee, had asked that the class period be extended back to September 2017, but Lydon denied that request because he provided “no explanation” for his attempt to expand the scope of ...
