Schlichter Bogard Denied Witness Fees in Edison 401(k) Battle

Schlichter Bogard & Denton LLP can’t take nearly $1 million from a $13.2 million damages award to reimburse the expert witnesses it tapped in the course of securing a partial victory in a lawsuit over Edison International’s 401(k) fees, the Ninth Circuit ruled.

The district judge who denied the plaintiff-side law firm’s request was within his rights because the Edison plan participants prevailed on only one of 10 claims and the decision didn’t turn on any particular expert’s opinion, the appeals court said.
