Salesforce.com Workers Want Class After Reviving 401(k) Fee Suit

Salesforce.com Inc. employees who convinced the Ninth Circuit to revive a lawsuit challenging their 401(k) plan fees are calling on a California federal judge to certify the case as a class action covering up to 50,000 people.

The employees seek a class of all Salesforce plan participants and beneficiaries between March 2014 and July 2019 who invested in certain funds that they criticize as imprudent. The case turns on common questions affecting all potential class members, including whether Salesforce fulfilled its fiduciary duties under the Employee Retirement Income Security Act in managing the plan, the employees say.
