Mass General Brigham Inc. and Boston Children’s Hospital must defend allegations that they mismanaged their workers’ retirement plans after a federal judge issued a pair of orders allowing both lawsuits to advance.
Judge Angel Kelley denied both hospitals’ motions to dismiss in electronic orders docketed Wednesday in the US District Court for the District of Massachusetts. The allegations in both cases are sufficient to state claims for fiduciary breach under the Employee Retirement Income Security Act, she said.
