Prudential Long-Term Care Policy Rate Suit Denied Class Status

A Tufts University employee suing Prudential Insurance Co. of America over premium increases in her long-term care insurance policy lost her bid to have the case certified as a class action.

The employee failed to show that her proposed classes involve legal questions that can be resolved with common answers, Judge Richard G. Stearns of the US District Court for the District of Massachusetts said Thursday. The case centers on contract terms that have already been deemed ambiguous, Stearns said, and interpreting those terms will require an examination of party intentions that can’t be done on a class-wide basis.
