Paul Revere Beats Surgeon’s Disability Suit Over Covid Risks

Paul Revere Life Insurance Co. validly denied disability benefits to an immunocompromised oral surgeon who stopped working after failing to secure personal protective equipment during the Covid-19 pandemic, a federal judge ruled.

It was the surgeon’s “actions and decisions, and not his comorbitities” that made it allegedly impossible for him to return to work during the pandemic, Magistrate Judge Christopher D. Baker said in a March 8 opinion upholding Paul Revere’s denial of benefits under an individual disability policy and a policy covering business overhead expenses.
