Oshkosh’s 401(k) Win Will Stand Despite Looming SCOTUS Ruling

A decision dismissing claims of 401(k) mismanagement by Oshkosh Corp. will stand after a federal judge in Wisconsin said he won’t reconsider his ruling when the U.S. Supreme Court decides a similar case against Northwestern University.

The Oshkosh workers presented “no basis” for vacating the September decision rejecting their Employee Retirement Income Security Act lawsuit, Judge William C. Griesbach of the U.S. District Court for the Eastern District of Wisconsin said Oct. 22. The Supreme Court’s decision to hear Hughes v.
