O’Reilly Automotive Beats Would-be Class Suit Over 401(k) Fees

Six former O’Reilly Automotive Inc. employees lost their lawsuit claiming the company mismanaged its $1.1 billion 401(k) plan by offering overly expensive funds and charging high fees.

Judge Brian C. Wimes orally granted the auto parts supplier’s motion to dismiss during a Tuesday hearing in the US District Court for the Western District of Missouri. Wimes, who didn’t issue a written explanation for his decision, also blocked the employees from trying again with an amended complaint.
