Oklahoma Wants Redo in Appeal Over Pharmacy Benefit Manager Law

Oklahoma’s insurance department asked the Tenth Circuit to rethink its recent decision invalidating part of a state law regulating pharmacy benefit managers, saying the decision conflicts with a recent ruling from the US Supreme Court.

The Supreme Court in 2020 “unanimously upheld” multiple provisions of a similar Arkansas law and established a “stringent standard” for assessing whether laws like this are preempted by the federal Employee Retirement Income Security Act, the department said in a petition for rehearing filed Wednesday in the US Court of Appeals for the Tenth Circuit.
