NYU Workers’ Claims Against Retirement Adviser Revived on Appeal

New York University workers can move forward with claims against Cammack LaRhette Advisors LLC over its handling of their retirement plans, the U.S. Court of Appeals for the Second Circuit ruled Oct. 1.

The workers’ claims against Cammack aren’t barred by their earlier lawsuit raising substantially similar claims against NYU, the court said. Cammack and NYU had “separate and distinct responsibilities” with respect to the retirement plans, and the district judge was wrong to conclude that the two entities were so entwined that the earlier case against NYU blocked subsequent claims against Cammack, the court said.
