NY Life Unit Must Reassess Benefits After In-Person Care Lapse

Life Insurance Co. of North America must reconsider an Accenture LLP employee’s claim for disability benefits after the parties disputed whether she was required to undergo an in-person medical exam during the early days of the Covid-19 pandemic.

There’s currently not enough evidence in the record to determine whether the employee is entitled to disability benefits, Judge Christopher A. Boyko said. Boyko denied both sides’ motions for judgment and sent the dispute back to LINA, saying that the employee will be given the opportunity to submit additional medical evidence, and LINA “may require” her to undergo an in-person evaluation ...
