Northrop Retirees’ New Judge Request Falls Flat in Ninth Circuit

Northrop Grumman Corp. retirees who say they were misled about their pensions failed to convince the Ninth Circuit to reassign their case away from the district judge who’s twice dismissed their claims.

The appeals court on Monday denied the retirees’ motion to have the lawsuit reassigned from Judge Otis D. Wright II of the US District Court for the Central District of California. The retirees said Wright should be replaced because his two decisions dismissing their claims—which were largely reversed on appeal—show he’s “intractably committed” to the idea that erroneous pension benefit statements don’t cause “actionable harm” to the workers ...
