Northrop Can’t Undo 9th Cir. Revival of Pension Cut Class Action

Northrop Grumman Corp. failed to convince the Ninth Circuit to rethink a decision reviving litigation over how the aerospace company calculated pensions for certain employees of predecessor entities.

The US Court of Appeals for the Ninth Circuit on Friday denied Northrop’s rehearing petition, which argued the court improperly ruled for retirees on a claim for minimum plan benefits they never pleaded and lacked standing to pursue. Northrop also said the court “misconstrued” the Employee Retirement Income Security Act’s six-year deadline to sue and improperly revived a decades-old claim.
