North Dakota Drug-Pricing Law Not Barred by Federal Benefits Law

A federal judge largely upheld a North Dakota law that limits how companies such as Express Scripts, CVS Health, and UnitedHealth Group profit from prescription drug sales.

The 2017 North Dakota drug-pricing law isn’t barred by the Employee Retirement Income Security Act and the Medicare Part D, save one provision requiring pharmacy benefit managers (PBMs) to disclose certain information to health insurance plans, Chief Judge Daniel L. Hovland of the U.S. District Court for the District of North Dakota held Sept. 5.
