NFL Players’ Retirement Plan Owes $295K in Fees in Disability Row

The National Football League’s retirement plan must pay $295,235 in attorneys’ fees and litigation costs to former cornerback Charles Dimry after his successful lawsuit to recover disability benefits.

A fee award is appropriate because Dimry achieved considerable success on the merits of his claim under the Employee Retirement Income Security Act, Judge James Donato of the U.S. District Court for the Northern District of California held Dec. 21.

The ruling comes nine months after Donato held that the league’s plan failed to properly examine Dimry’s medical records and denied benefits based on an unreasonable bias in favor of plan-selected doctors. ...
