NFL Benefit Plan Fights Suit by Lineman From Famous 1985 Bears

The National Football League’s retirement plan again tried to trim a lawsuit by a former defensive lineman on the Chicago Bears 1985 Super Bowl-winning team, arguing he can’t mount an ERISA claim based on “silence.”

Tyrone Keys is fighting with the league’s plan over more than $800,000 in disability benefits that the plan says never should have been paid. Keys received benefits for nearly 30 years for his football-related injuries, but the plan ended those benefits and demanded repayment in 2017 when it determined that Keys didn’t accurately report a 2002 car accident that contributed to his health problems.
