NetApp Can’t Escape Lawsuit Over Termination of Health Benefits

NetApp Inc. must defend a lawsuit by seven former top executives who are challenging the company’s termination of lifetime health benefits for them and their dependents.

U.S. District Judge Beth Labson Freeman declined to consider, for now, NetApp’s argument that it was allowed to eliminate lifetime health benefits in its health plan because it had reserved the right to do so (Gomo v. NetApp, Inc., 2017 BL 394855, N.D. Cal., No. 5:17-cv-02990-BLF, order denying defendant’s motion to dismiss 11/1/17).
