Nemours Foundation’s $2.3 Million Retirement Plan Deal Stumbles

A federal magistrate judge declined to sign off on a $2.275 million class settlement between Nemours Foundation and employees covered by its retirement plans, saying the workers didn’t explain why class-wide resolution was appropriate.

The workers’ court filings never addressed the federal rules governing class action settlements, which require arms-length negotiations, adequate representation, and equitable treatment for class members, Magistrate Judge Laura Lothman Lambert of the US District Court for the Middle District of Florida said in a Dec. 12 order.
