Nemours Foundation Retirement Fee Challenge Poised to Advance

A lawsuit saying Nemours Foundation mismanages its $1 billion retirement plan through excessive administrative fees inched forward when a federal magistrate judge said the pediatric health system’s motion to dismiss should be denied.

The dispute turns on factual questions that would be better resolved after the parties engage in discovery, Magistrate Judge Laura Lothman Lambert of the US District Court for the Middle District of Florida said in a Jan. 17 recommendation. Lambert cited recent decisions in which judges in her district allowed similar lawsuits to advance against Embry-Riddle Aeronautical University Inc. and TriNet HR III Inc.
