NCR Corp. Seeks Dismissal of Retirement Plan Fee Class Challenge

NCR Corp. defended its $2 billion 401(k) plan from allegations of high fees, saying the former employees who filed suit didn’t raise the issue internally or put forth valid benchmarks for measuring plan fees.

The employees provided no facts suggesting NCR used an improper process for monitoring the plan’s recordkeeping fees, the company said in a motion to dismiss filed Monday in the US District Court for the Northern District of Georgia. They also conflated and misrepresented information in the company’s government filings to suggest the plan’s fees were higher than they truly were, NCR said.
