NCR Corp. Execs Win Class Status in Retirement Battle

Former executives of ATM maker NCR Corp. won partial class action status in their lawsuit accusing the company’s benefit plan administrator of shortchanging their retirement benefits (Hoak v. Plan Admin. of Plan of NCR Corp., N.D. Ga., No. 1:15-cv-03983-AT, order granting class certification in part 9/27/17).

A federal judge Sept. 27 gave the executives permission to litigate two of their claims as a certified class or subclass: that the NCR administrator wrongly terminated their retirement plans and that it calculated their benefits using unfavorable actuarial assumptions.
