The National Basketball Association’s pension plan asked a federal appeals court to toss a lawsuit by a 73-year-old former player who the plan says filed suit far too late.
Zaid Abdul-Aziz, who retired from the league in 1978 after a 10-year career with multiple teams, has no basis for seeking new cost-of-living adjustments added to the plan years after his retirement, the plan told the Second Circuit in a June 25 brief.
The plan cautioned the Second Circuit that Abdul-Aziz’s legal theory would have massive, nationwide consequences.
